This contest is not governed by Italian Presidential Decree n°. 430 of 26/10/2001, article 6

1. PROMOTING SUBJECT
BETA UTENSILI S.P.A. - Via Volta, 18 - 20845 Sovico (MB) – Italy, VAT Number and Tax Code 09321470966 (“Promoting Company”)

2. DELEGATED SUBJECT
Beta Utensili S.p.A. has appointed Giorgi Patrizia, with its principal office in via Alleva 5/A – 28010 Fontaneto d’Agogna (NO), VAT Number 02157970035 (“Representative”) as Delegated Subject, for the purpose of fulfilling the obligations relating to the contest, under article 5, paragraph 3, of Italian Presidential Decree 430/2001.

4. DURATION
Contest period: from 22/06/2018 to 03/08/2018.

5. TERRITORY
International territory.

6. CONTESTANTS
The contest is open to all Internet users, resident worldwide (“User/Users”).
Participation in the #80voglia di Beta contest is free.

7. PURPOSES
Promoting the knowledge and visibility of the brand of the Promoting Company and its products, and collecting photographic material for marketing activities.

8. HOW TO ENTER THIS CONTEST
By participating in this contest, users unconditionally and fully agree to the rules and terms contained herein without any limitation. Participation in this contest is free, provided that all the terms and conditions contained herein are complied with.
The submitters of the selected pictures will receive a complimentary Beta gadget and 5 copies of the 2019 Beta calendar.

9. PARTICIPATION PROCEDURE
To participate in the contest, the user must send a picture of him/her with one or more Beta products to 80vogliadibeta@beta-tools.com, during such period as stated in the section “Duration”. Both individual and group photos are allowed.
The e-mail will contain the following data: name or nickname; a caption of maximum 120 characters can be added. Each participant may send one photo. Alternatively, to participate in the contest, he/she may post the picture to his/her Facebook profile, tagging the fanpage @BetaUtensiliSpA
We will choose the nicest and funniest pictures that are in line with the values of the brand, and use them for the 2019 company calendar.
The Promoting Company and its representative will assume no responsibility for any access problem, impediment, malfunction or difficulty that may prevent the user from accessing the service and participating in the contest.

10. ADMITTED PHOTOS
Selfies, individual or group photos. Participants must be photographed with one of Beta’s products. Photo size must not exceed 8 MB; only jpg files are allowed. Pictures that do not satisfy the above requirements, violate common decency or contain advertising and/or political references, photo montages, pictures with signatures or watermarks will not be accepted.
It should be pointed out that, in case of pictures with under-age persons (who must necessarily be photographed with a participant aged eighteen or over), a written authorisation signed by a parent or a legal guardian is required. By sending their contents, participants agree that the photos may be published in the Gallery of Beta Utensili’s Facebook page (www.facebook.com/BetaUtensiliSpA) and waive any and all rights thereto (such rights will be granted to the Promoting Company) and may not claim for compensation; furthermore, the contents must not be covered by copyright and will not be returned. By sending the contents, participants assume all responsibility therefor; indeed, by agreeing to enter the contest, participants represent and warrant that:
- the contents sent are original and do not infringe copyright and/or related rights and/or trademark rights / trade secrets / image rights or any other right to commercial and/or industrial and intellectual exploitation of any individual person or legal entity;
- they will indemnify and hold the Promoting Company and its assignees harmless from and against any and all prejudicial consequences, costs and damage which may result from the violation of this representation and warranty. In particular, participants will defend and hold the Promoting Company harmless from and against such damage (including costs) as participants may be required to pay to third parties following: an action or warning based on the fact that the mere possession or use of the contents by the Promoting Company infringes, or has infringed, copyright, the right to a registered trademark, patent rights, know-how rights, rights of invention, image and any other exclusive rights of third parties; any prejudicial consequence caused by the publication of contents deemed offensive or contrary to public morality (vulgarity, violent scenes, illegal activities etc.);
- they are aware, and agree that the pictures sent to 80vogliadibeta@beta-tools.com will be used and disseminated on the Facebook page of Beta Utensili S.p.A. (www.facebook.com/BetaUtensiliSpA), and they are aware that the said photo contributions will therefore be indiscriminately accessible to the general public. Beta Utensili S.p.A. will not disseminate the pictures for any purposes other than the purposes of this contest.
By agreeing to the terms and conditions, participants will hold the organizers harmless from and against improper use of the pictures by third parties.

11. PERSONAL DATA PROCESSING
Participants in this contest agree that personal data provided to Beta Utensili S.p.A. in relation to participation in the contest may be processed pursuant to Italian Legislative Decree n°. 196 of 30/06/2003, provided that participants may exercise such rights as referred to in article 7 of the said law.
